| Abstract: | Special Issue 30th Anniversary of the Break-up of the USSR Chart of the month Post-Soviet space marked by economic divergence by Vasily Astrov 30 years without the USSR outcomes and lessons by Ruslan Grinberg The demise of the Soviet Union 30 years ago was very abrupt and largely unexpected, even by those who set it in motion. The economic consequences of its collapse as well as those of fully embracing free market ideology without preserving the benefits of the former system proved catastrophic. The current anti-democratic and anti-western backlash in Russia is arguably the result of these policy missteps and could have been avoided, had different policies been pursued at the time. Goodbye to the ‘post-Soviet space’ by Vladislav L. Inozemtsev Thirty years after the break-up of the USSR, the term ‘post-Soviet space’ is no longer appropriate. On the one hand, there has been a sharp economic divergence between the post-Soviet republics, with the southern ‘periphery’ performing much better than the western regions. On the other hand, Russia’s foreign policy has focused increasingly on Belarus and Ukraine, opening up opportunities in Central Asia for other global players. Laws of disintegration by Artem Kochnev When it comes to analysis of the Soviet legacy in Europe, one can hardly avoid discussions about unrecognised states. This piece contributes to the discussion by analysing the constitutional design of the late Soviet Union. It argues that the origins of the breakaway republics were rooted in a contradictory institutional design, which provided political leaders with both the legitimacy and the legal grounds to exploit a nationalist agenda amid rising political activism. | Abstract: | Останнім часом не вщухає дискусія щодо подальшої долі Господарського кодексу України. Міноритарна група цивілістів ліворадикального толку виступають за його безапеляційну ліквідацію та нормативну консолідацію всієї сукупності приватноправових відносин в межах одного кодифікованого акту. Зазначимо що ідея запровадження «єдиного цивільного кодексу приватного життя» немає під собою будь-якого теоретичного підґрунтя. Крім того її реалізація призведе до деформації сталих принципи юридичної техніки, серед яких простота та придатність правового акту до застосування. Сьогодні ми стаємо свідками детальної структуризації приватноправових відносин, їх автономної нормативної регламентації. Прикладом є відносини в сфері IT права, медичного права і спортивного права тощо. Секуляризація Господарського кодексу України не той шлях, яким слід вирішувати проблему колізії правових актів. Тому підтвердженням є світовий досвід, зокрема досвід Франції. Для правової системи Франції характерний дуалізм приватного права, якому присутня відокремленість правових норм в регулюванні торгівельної (комерційної) діяльності від норм цивільного права. Це форма внутрішнього розподілу, яка не порушує галузеву цілісність та дозволяє враховувати особливості правового регулювання комерційних відносин. В такому разі, відповідні комерційні правовідносини не противляться цивільним, навпаки підкреслюють певний рівень їх системної диференціації в межах єдиного цивільного права. Сформована в середні 16 століття правова традиція окремого правового регулювання відносин комерційного характеру, що обумовлено характером суспільноекономічної формації того часу зберегла свої риси й на сучасному етапі розвитку приватного права Франції. Природа та характер цивільних відносин і комерційних (підприємницьких) відносин об'єктивно має певну специфіку їх правового регулювання, що обумовлює використання окремих правових засобів регулювання таких відносин. Але, наведене не стільки відокремлює комерційне (підприємницьке) право від цивільного, скільки специфікує його в межах такого. Така специфікація всередині системи цивільного права Франції обумовлена однорідністю комерційного (підприємницького) права на відміну від цивільного права Франції. Комерційне право Франції регулює достатньо вузьку сферу суспільних відносин, які мають власне нормативно-правове підґрунтя, яке опосередковує таку сферу. |

| Abstract: | Combining two new datasets on sanctions and agricultural trade and implementing step-by-step the latest developments in the empirical structural gravity literature, we investigate the effects of sanctions on international trade of agricultural products. We find that trade sanctions have been effective in impeding agricultural trade, while other sanctions do not show any significant effects. The complete trade sanctions in our sample have led to about a 73% decrease in the agricultural trade between the sanctioned and sanctioning countries, or a corresponding tariff equivalent of 38.8%, but we also obtain significant estimates for partial sanctions. At the industry level, we find substantial heterogeneity depending on the sanctioning and sanctioned countries, the type of sanctions used, and the direction of trade flows. Focusing on the sanctions on Russia, we find that these sanctions substantially decreased bilateral trade of Russia, mainly due to reduced trade with the EU. |

| Abstract: | After a number of critical setbacks and delays in the 16 months since program approval, the authorities have taken important corrective actions to address shocks to program objectives. Early tension around the authorities’ commitment to uphold the independence of the National Bank of Ukraine required a pause to assess policy continuity and to determine possible corrective actions. A prior action for this review and new commitments by the authorities provide a way forward in protecting a key policy pillar under the program. Similarly, adverse Constitutional Court rulings challenged the anticorruption framework in fundamental ways that required restoring its effectiveness before the review could proceed. In a push to make progress on delayed structural benchmarks, the authorities have recently met seven of the nine structural benchmarks set at the time of the program request. |
